Need to know how to clear my report of shared bills that were awarded to him in divorce and cleared through his bankruptcy.

Divorce sucks doesn%26#039;t it. People make it sound simple, but it seldom is.



Unfortunately you have two options



1) don%26#039;t worry about it, but realize that for seven + years you will have bad credit. If you don%26#039;t plan to buy a car, a house, get credit cards, etc., during the 7 years, you%26#039;ll be fine.



2) talk with an attorney, the court, or others who may be able to show the creditors your divorce papers and show them you are not responcible. Unfortunately this option will cost you money, time and frustration.

You might need an attorney to convince the creditors to remove them from your credit as stipulated in your divorce decree. Most companies will still consider you liable no matter what the decree says.

I went thru this same thing. Unfortunately you can%26#039;t! If you%26#039;re name was attached to those bills, they%26#039;ll stay on your credit. I was advised by both my attorney and my creditors that while a divorce may divvy up bills and such, it does not legally terminate your responsibility. The creditors are not required to remove them from your credit report. You can put in a %26quot;consumer statement%26quot; though clarifying the situation so when people pull your credit they%26#039;ll get the whole picture.

Your divorce decree means NOTHING to your creditors. They are not obligated to abide by the terms of your divorce. Only you and your ex-husband are bound by what the divorce decree states. If you contact the creditors, I am guessing that they will come after YOU to get payment. After all, technically you are responsible for paying those debts.



I suppose a copy of his bankruptcy and your divorce decree COULD be sent to all 3 credit reporting agencies, but I do not think they have an obligation to remove the debts, under the circumstances.

Do check with an attorney ... my sister works for a bankruptcy attorney clearning up such things from a credit report. If you have filed bankruptcy, those creditors have remove much of the garbage from your report. They can be sued by the attorney -- they will PAY you and the attorney to settle AND get much of that stuff off your report.



It does take about six months to get it all cleared. But it worked for me after my divorce.

In the real world divorce decrees mean nothing to creditors.
